Zyrrah Waitlist:
Terms and Conditions

These Terms and Conditions (“Terms”) govern your registration on the Zyrrah waitlist via our website. By submitting your details, you agree to these Terms. If you do not agree, please do not join the waitlist.

1. About us

The Zyrrah waitlist is operated by Pulse Australasia Pty Ltd (ABN 34 154 929 450), trading as Zyrrah (“Zyrrah”, “we”, “us”, “our”). Zyrrah is a psychological wellbeing app currently in pre-launch.

2. What the waitlist is

The waitlist is a pre-launch registration list. Joining the waitlist means:

  • you'll receive email updates from us about Zyrrah, including launch news, founding member benefits, referral rewards, and related communications;
  • you may be allocated a Founding Member number, which is indicative only and confers no contractual entitlement;
  • you may be offered early access, trial periods, buddy passes, or referral rewards before or at launch.

The waitlist does not guarantee access to the Zyrrah app. We may change, delay, or cancel the launch, the waitlist, or any associated offers at any time without notice or liability.

3. Eligibility

To join the waitlist, you must be at least 18 years old and provide accurate, current information. We may remove any registration we reasonably believe is fraudulent, duplicated, or non-compliant with these Terms.

The Zyrrah app may, at launch, offer access to users under 18 through a separate parental or guardian consent process. That process is not part of this waitlist, and the waitlist itself is not open to minors.

4. Collection notice

At the point of signup, we collect your name and email address. We collect this information to add you to our waitlist, send you the email communications described in section 5, administer founding member benefits and referrals, and improve our service.

If you do not provide this information, we cannot register you on the waitlist. Our full Privacy Policy — which explains how to access or correct your information, how to make a privacy complaint to us or to the Office of the Australian Information Commissioner (OAIC), our data retention practices, and our overseas disclosure safeguards is available at our Privacy Policy and forms part of these Terms.

5. How we use your information and your marketing consent

We use the information you provide to:

  • add you to our customer relationship management (CRM) system;
  • send you emails about Zyrrah, including launch updates, founding member content, referral rewards, product news, and promotional material;
  • administer founding member numbers, buddy passes, and referral rewards;
  • improve our service and communications;
  • comply with our legal obligations.

Marketing consent (Spam Act 2003). When you join the waitlist, you will be asked to tick a separate consent box confirming that you agree to receive commercial electronic messages from Zyrrah under the Spam Act 2003 (Cth). You can withdraw that consent at any time using the unsubscribe link in any email, or by contacting us directly at admin@zyrrah.app. Once you unsubscribe, we will stop sending you marketing emails, though we may still contact you about important account or service matters.

We handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Full details are set out in our Privacy Policy, which forms part of these Terms.

6. CRM, storage, and overseas disclosure

Your information is stored in our CRM and supporting systems, which may be operated by third-party service providers (including email delivery, analytics, and hosting providers). Some of these providers store or process information overseas, including in the United States and the European Union.

In accordance with APP 8, we take reasonable steps to ensure that overseas recipients handle your information consistently with the Australian Privacy Principles, including through contractual safeguards. The specific safeguards we apply are set out in our Privacy Policy.

We do not sell your personal information.

7. Founding member, buddy pass, and referral rewards

We may offer founding member benefits, buddy passes, and referral rewards (such as free trial periods or extended free access) to waitlist members. These offers are made at our discretion and are subject to additional terms communicated at the time of the offer, including any specific tier structure (for example, free access tied to a number of successful referrals).

We may modify, suspend, or withdraw any benefit, pass, or reward at any time.

How referrals work

Our referral program is link-based. When you refer someone, we provide you with a unique referral link or Buddy Pass code. You share that link or code with the people you choose, through your own channels such as text message, email, social media, or in person. Zyrrah does not collect or contact any third party on your behalf, and we do not ask you to provide anyone else's contact details.

When the person you've shared the link with chooses to join the waitlist or sign up to Zyrrah, they do so directly providing their own information and giving their own consent to our Terms and Privacy Policy. We only ever hold personal information that the person has provided to us themselves.

Successful referrals

A “successful referral” requires the person you have referred to validly join the waitlist or app using your unique link or code. We may exclude referrals we reasonably believe are fraudulent, automated, self-referrals, or otherwise gamed.

Your responsibilities when sharing

When sharing your referral link or Buddy Pass code, you agree to:

  • only share with people you have an existing personal, family, or domestic relationship with, or who you reasonably believe would be interested in Zyrrah;
  • not share through channels that constitute spam, bulk unsolicited messaging, or harassment;
  • not share in any way that misrepresents Zyrrah, the offer, or your relationship with us;
  • comply with the Spam Act 2003 (Cth) and any other laws that apply to your own communications.

You are responsible for the messages you send when sharing your referral link. Zyrrah is not the sender of those messages and is not liable for how you choose to share.

Promotional designations

Any references to founding member numbers, tiers, or status (including “Golden Hour” or similar designations) are promotional and confer no ownership, equity, or guaranteed entitlement to any service.

8. Not medical or psychological advice

Zyrrah is a wellbeing app designed to support general psychological wellbeing. It is not a substitute for professional medical, psychological, or mental health advice, diagnosis, or treatment. Any waitlist content, marketing email, or pre-launch material is general in nature and provided for information only.

If you are experiencing distress or a mental health crisis, please contact a qualified health professional or emergency services in your area.

9. Intellectual property

All content on our website and in our emails — including the Zyrrah name, logo, copy, and design — is owned by or licensed to Pulse Australasia Pty Ltd. You must not copy, reproduce, or use it without our written permission, except for personal, non-commercial use.

10. Acceptable use

You agree not to:

  • provide false or misleading information;
  • use the waitlist or referral system to send spam, bulk unsolicited messages, or harass others;
  • share your referral link or Buddy Pass code in any way that breaches the Spam Act 2003 (Cth), or any other applicable law;
  • misrepresent Zyrrah, our offers, or your relationship with us when sharing your referral link or Buddy Pass code;
  • attempt to interfere with, reverse-engineer, or exploit our systems;
  • use the waitlist for any unlawful purpose.

We may suspend or remove your registration, or disable your referral link, if you breach these Terms.

11. Indemnity

You agree to indemnify Pulse Australasia Pty Ltd against any loss, claim, or cost (including reasonable legal fees) arising from your breach of these Terms or your misuse of the waitlist or referral system.

12. Liability

To the maximum extent permitted by law, Pulse Australasia Pty Ltd is not liable for any loss or damage (including indirect or consequential loss) arising from your use of the waitlist, our emails, or any pre-launch material. Nothing in these Terms excludes any guarantees, rights, or remedies you have under the Australian Consumer Law that cannot lawfully be excluded.

13. Privacy complaints and dispute resolution

Privacy complaints. If you have a concern about how we have handled your personal information, please contact us first at admin@zyrrah.app. We will acknowledge your complaint within a reasonable time and work with you to resolve it. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

Other disputes. For any other concern, please contact us first at admin@zyrrah.app so we can try to resolve it. If we cannot resolve the matter within a reasonable time, both parties agree to attempt resolution through mediation before commencing court proceedings, except where urgent relief is required.

14. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on our website, and material changes will be communicated by email or on the website. Continuing on the waitlist after changes means you accept the updated Terms.

15. Severability

If any provision of these Terms is found by a court or tribunal to be invalid, illegal, or unenforceable, that provision will be severed and the remaining Terms will continue in full force and effect.

16. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pulse Australasia Pty Ltd in relation to the Zyrrah waitlist, and supersede any prior representations or understandings.

17. Governing law

These Terms are governed by the laws of Queensland, Australia, and you submit to the exclusive jurisdiction of the courts of that State.
